CRANBOURN® Brand Assets & Media Policy

CRANBOURN® brand assets, trademarks, photography, videography, creative content, soundscapes, atmosphere playlists, product imagery, packaging designs, website content and associated intellectual property are valuable business assets owned by or licensed to CRANBOURN® Holdings Limited (“CRANBOURN®“, “we”, “us” or “our”).

This Brand Assets & Media Policy explains how authorised third parties may access, use and reproduce CRANBOURN® content and identifies the restrictions that apply to such use.

By downloading, accessing, reproducing, publishing, sharing or otherwise using any CRANBOURN® content, you agree to comply with this Policy.

1. Intellectual Property Ownership

Unless otherwise stated, all content made available by CRANBOURN® is protected by copyright, trademark, design right and other intellectual property laws in the United Kingdom, European Union, United States and other jurisdictions.

This includes, without limitation:

  • CRANBOURN® trademarks, logos and word marks;
  • registered and unregistered trademarks, service marks, slogans and brand identifiers associated with CRANBOURN®;
  • The Art of Atmospheres;
  • The Architecture of Scent;
  • Atmosphere;
  • product names and fragrance collection names;
  • product photography and lifestyle imagery;
  • videos and motion content;
  • website copy and editorial content;
  • soundscapes and atmosphere playlists;
  • packaging designs, artwork and graphics;
  • trade dress and product presentation;
  • all associated metadata, descriptions and creative assets; and
  • all other intellectual property rights owned by or licensed to CRANBOURN®.

All rights not expressly granted under this Policy are reserved by CRANBOURN®.

2. Permitted Uses

Subject to compliance with this Policy, authorised retailers, distributors, journalists, media organisations, architects, interior designers, hospitality partners and other approved third parties may use CRANBOURN® content solely for legitimate editorial, promotional, educational or commercial purposes directly related to CRANBOURN® products and services.

Permitted uses may include:

  • editorial coverage and reviews;
  • authorised retailer and distributor product listings;
  • trade and wholesale presentations;
  • press articles and media features;
  • interior design, hospitality and specification presentations;
  • social media posts referencing CRANBOURN®;
  • educational or informational content relating to CRANBOURN®; and
  • other uses expressly authorised in writing by CRANBOURN®.

3. Press and Editorial Use

Accredited journalists, publishers, bloggers, content creators and media organisations may use approved CRANBOURN® press materials for genuine editorial purposes, provided that such use is accurate, non-misleading and properly attributed where appropriate.

Editorial use does not imply endorsement, sponsorship or partnership unless expressly stated by CRANBOURN®.

4. Retailers, Distributors and Trade Partners

Authorised retailers, distributors, hospitality partners and trade customers may use approved CRANBOURN® brand assets solely for the promotion, specification and sale of genuine CRANBOURN® products.

All such use must comply with current CRANBOURN® brand guidelines and may be withdrawn by CRANBOURN® at any time.

No rights are granted to create derivative brands, co-branded products, modified packaging or alternative product presentations unless expressly authorised in writing.

5. Restricted Uses

Unless expressly authorised in writing by CRANBOURN®, you must not:

  • use CRANBOURN® content in any unlawful, misleading, defamatory, fraudulent or deceptive manner;
  • modify, distort or alter trademarks, logos or proprietary branding elements;
  • use content in a manner that implies endorsement, sponsorship or partnership where none exists;
  • register or attempt to register any CRANBOURN® trademark, logo, design, domain name, social media handle or confusingly similar variation;
  • use CRANBOURN® content in connection with counterfeit, imitation or unauthorised products;
  • use CRANBOURN® content on online marketplaces or resale platforms without authorisation;
  • use content in connection with political campaigns, lobbying activities or fundraising initiatives;
  • use content in connection with pornography, hate speech, discrimination, violence or illegal activities;
  • extract, distribute or make available content as a standalone downloadable asset;
  • remove copyright notices, trademarks, watermarks or metadata;
  • misrepresent CRANBOURN® products, ingredients, certifications or sustainability credentials; or
  • use CRANBOURN® content in any manner that may damage the reputation, goodwill or intellectual property rights of CRANBOURN®.

6. Artificial Intelligence and Machine Learning

CRANBOURN® content may not be scraped, harvested, downloaded, copied, reproduced, adapted or otherwise used for:

  • artificial intelligence training;
  • machine learning datasets;
  • large language models;
  • image generation systems;
  • synthetic content creation;
  • computer vision systems;
  • facial recognition technologies;
  • automated data extraction; or
  • any model development, training or optimisation activities.

This restriction applies to all content, including imagery, videos, soundscapes, atmosphere playlists, metadata, captions, descriptions and associated creative materials.

7. Social Media and Influencer Use

Content may be shared on social media platforms provided that:

  • the content is presented accurately and respectfully;
  • CRANBOURN® trademarks remain unaltered;
  • no misleading endorsement is implied;
  • all applicable advertising and disclosure requirements are followed; and
  • any sponsored, gifted or incentivised content complies with applicable laws and regulations, including guidance issued by the UK Advertising Standards Authority (ASA), the US Federal Trade Commission (FTC) and equivalent regulatory authorities.

8. User Generated Content

If you tag, mention or submit content featuring CRANBOURN® products, you retain ownership of your content.

Where you respond positively to a request from CRANBOURN® to share, repost or feature such content, you grant CRANBOURN® a non-exclusive, royalty-free, worldwide licence to reproduce, display, publish and distribute that content in connection with its marketing, promotional and editorial activities.

9. Sustainability and Certification Claims

Any reference to CRANBOURN®‘s sustainability credentials, certifications or environmental initiatives must be accurate, current and supported by official CRANBOURN® materials.

This includes, without limitation:

  • B Corp Certification;
  • Leaping Bunny Certification;
  • Vegetarian Society Certification;
  • FSC-certified packaging;
  • 1% for the Planet membership; and
  • other sustainability, environmental or ethical claims.

Users must not make exaggerated, misleading or unsubstantiated environmental, sustainability or ethical claims concerning CRANBOURN® products.

10. Attribution

Where attribution is required, content should be credited as:

11. Reporting Intellectual Property Concerns

If you believe any content associated with CRANBOURN® infringes your copyright, trademark or other intellectual property rights, please contact us at enquiries@cranbourn.com.

We will investigate and respond appropriately in accordance with applicable laws.

12. Termination of Rights

CRANBOURN® reserves the right to withdraw, suspend or terminate permission to use any content at any time.

Upon request, users must promptly cease use of the relevant content and remove or destroy copies within their control.

13. Reservation of Rights

Nothing in this Policy transfers ownership of any intellectual property rights to any third party.

CRANBOURN® expressly reserves all rights not expressly granted under this Policy.

14. Governing Law

This Policy shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction over any dispute arising from or relating to this Policy.
